In the event of disruptions in rail transport, statutory passenger rights in accordance with the regulation 2021/782 of the European Union apply to users of the Deutschlandticket. Rail transport includes all trains, irrespective of which railway company they are operated by, except subways (U-Bahn). The disruption must have occured in rail transport when using the Deutschlandticket. For example, the following rules do not apply if the late arrival at the destination station ...
- is due to a prior delay of a bus, or
- to a prior delay of another train for which a separate ticket has been purchased, e.g. when traveling by long-distance train from the south to Hamburg and subsequent use of the Deutschlandticket for the onward journey.
- This also applies in the opposite direction: If the Deutschlandticket is used first and a separate ticket is purchased for the onward journey from Hamburg, the regulations do not apply to any loss of connection in Hamburg, as in this case each ticket represents a separate contract.
Compensation in the case of late arrival at the destination stationDeutschlandticket users are entitled to compensation in accordance with statutory passenger rights:
- In the event of a delay at the entire route's destination station of 60 minutes or more due to train delay, missed connecting trains or train cancellations, the amount of the lump sum for season tickets is 1,50 Euro per individual case.
- Compensation amounts of less than 4,00 Euro will not be paid. Thus, you must be affected by at least three relevant delays per semester.
- A maximum of 25% of the ticket value will be paid out overall.
Railway companies are not obliged to pay compensation if the disruption occurred as a direct consequence of or in inseparable connection with one of the following events:
- extraordinary circumstances external to railway operations, e.g. natural disasters,
- behaviour of a third party, e.g. emergencies on the train, persons on the tracks, law enforcement measures, sabotage, cable theft.
Note: Strikes are not considered exceptional circumstances.Application for compensation:1.) Fill out the passenger rights formFor each individual journey with a delay of 60 minutes or more, a passenger rights form must be completed. The passenger rights form is available on the train from the conductor, at the DB information desk and in the DB Travel Centers as well as online at this link. You are advised to submit one claim for all cases of delay at the end of the semester. Claims can be asserted retroactively for up to one year.2.) Provide proofThe passenger rights form must be accompanied by a copy of the Semesterticket Schleswig-Holstein. Otherwise compensation is not possible. When using the mobile ticket, please enclose a printout of the third page of your personal mobile phone ticket (sample) instead. Please note that the term of the semester ticket includes the date of the journey for which you are applying for compensation.3.) Submit documentsIs everything complete? Then you can submit the documents at a DB Travel Center and the DB information desk or send them by post to the Servicecenter Fahrgastrechte, 60647 Frankfurt/Main. The application will be processed within one monthFor further information on statutory passenger rights in rail travel see www.fahrgastrechte.info (german).
Continuing with another trainThe Deutschlandticket is an offer with a significantly reduced fare within the meaning of § 3 Eisenbahnverkehrs-Verordnung (EVO). Therefore, in the event of a cancellation or delay, there is no entitlement to free onward travel on long-distance trains (ICE, IC, EC, Sylt Shuttle Plus), unless these alternative trains are free for use with the Deutschlandticket by announcements or displays.Compensation by the NAH.SH-guarantee or the hvv-guaranteeThe NAH.SH-guarantee or the hvv-guarantee do not apply in conjunction with the Deutschlandticket due to the discounted fare.Passenger rights in the event of disruptions to bus servicesIn bus transport, the statutory passenger rights do not give rise to any compensation claims, as a scheduled journey time of at least three hours must be achieved by bus. -
